  1. O-1A Visa:

Key Requirements of the O-1 Visa:

  1. Extraordinary Ability or Achievement:
    • O-1A: The individual must demonstrate sustained national or international acclaim and recognition for achievements in their field of expertise. This can be shown through awards, published material, membership in associations that require outstanding achievements, and other significant evidence of extraordinary ability.
    • O-1B: The individual must demonstrate a record of extraordinary achievement in the motion picture or television industry (e.g., major awards or nominations) or distinction in the arts, evidenced by significant recognition, performances, or exhibitions.
  2. Consultation:
    • A written advisory opinion from a peer group, labor organization, or management organization in the individual’s field is typically required. This consultation letter assesses the nature of the work and the qualifications of the beneficiary.
  3. Job Offer:
    • The applicant must have a job offer from a U.S. employer. The employer serves as the petitioner and files the visa petition on behalf of the applicant.
  4. Form I-129, Petition for a Nonimmigrant Worker:
    • The U.S. employer must file Form I-129 with U.S. Citizenship and Immigration Services (USCIS) along with the O Supplement to Form I-129, the consultation letter, and supporting evidence of the applicant’s extraordinary ability or achievement.

Application Process:

  1. Employer Files Petition:
    • The U.S. employer files Form I-129 with supporting documentation to prove the applicant’s extraordinary ability or achievement and the nature of the job in the U.S.
  2. USCIS Review:
    • USCIS reviews the petition and, if approved, issues Form I-797, Notice of Action.
  3. Visa Application and Entry:
    • If the applicant is outside the U.S., they must apply for an O-1 visa at a U.S. Embassy or Consulate. Upon approval, they receive an O-1 visa stamp in their passport and may then enter the U.S.

Validity and Extensions:

  • The O-1 visa is typically granted for the duration of the event, performance, or activity for up to three years. Extensions can be granted in one-year increments as long as the extraordinary ability or achievement and the job in the U.S. continue.
